These Conditions of Use (“Terms”) govern your access to and use of the website located at filters4u.com (the “Site”), including any content, product catalogs, ordering tools, selection interfaces, customer portals, and services offered through the Site (collectively, the “Services”). The Site and Services are owned and operated by Filters4u, Inc. (“Filters4u,” “we,” “us,” or “our”).

By accessing, browsing, or using the Site or Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.

Eligibility and Authorized Use

2. Fit-for-use is your responsibility. Filtration performance depends on application-specific factors (airflow, VOC load, overspray characteristics, booth configuration, maintenance practices, and more). You are responsible for selecting products appropriate for your use and verifying compatibility with your equipment and regulatory requirements.
3. No professional advice. Information provided through the Site or support channels is for general informational purposes and is not engineering, EHS, environmental, regulatory, or legal advice.

Orders, Pricing, and Acceptance

1. Order placement. Submitting an order is an offer to purchase. We may accept or reject orders at our discretion.
2. Pricing. Prices are shown in U.S. dollars unless otherwise stated and may change at any time.
3. Taxes and fees. Applicable taxes, shipping, handling, surcharges, and other fees may apply and will be presented at checkout or on your invoice.
4. Errors. If a product is listed with incorrect pricing or information, we may cancel or refuse any order placed for that product. If you have been charged, we will issue a refund consistent with applicable law and our policies.
5. Payment. You agree to pay all charges using the payment method selected. If we offer invoicing or net terms, they are subject to approval and a separate written agreement.

Shipping, Delivery, Title, and Risk of Loss

1. Estimates. Delivery dates are estimates and not guarantees. Delays may occur due to carrier constraints, supply chain conditions, weather, or other factors.
2. Risk of loss. Unless otherwise stated in writing, title and risk of loss pass to you upon our tender of products to the carrier.
3. Inspection. Inspect shipments upon receipt and report visible damage or discrepancies promptly in accordance with claim procedures and carrier requirements.

Returns, Cancellations, and Refunds

1. Return policy. Returns and refunds are governed by our Return Policy. Certain items may be non-returnable, including (as examples) custom-cut media, special orders, used/installed products, or items without original packaging.
2. Cancellations. Cancellations may be limited once processing begins or for made-to-order items. Restocking or cancellation fees may apply as permitted by law and our policies.

Tools and Selection Interfaces

The Site may include product-selection interfaces (for example: exhaust/intake navigation, category counts, and material selectors). These tools are provided for convenience and do not guarantee product availability, suitability, or compliance for your specific application.

Counts, badges, and availability indicators may be approximate and may not reflect real-time inventory, lead times, manufacturing constraints, or carrier conditions.

Intellectual Property

1. Ownership. The Site and its content (text, graphics, logos, icons, images, software, UI/UX design, and other materials) are owned by or licensed to us and protected by applicable intellectual property laws.

Limitation of Liability

To the fullest extent permitted by law:

• Filters4u will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill arising from your use of the Site, Services, or products.
• Filters4u’s total liability for any claim relating to the Site, Services, or products will not exceed the amount you paid to us for the specific order giving rise to the claim, or $100, whichever is greater, unless otherwise required by law.

Some jurisdictions do not allow certain limitations; in such cases, these limitations apply to the maximum extent permitted.

Indemnification

You agree to indemnify and hold harmless Filters4u, Inc., its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from or related to: (a) your use of the Site or Services, (b) your violation of these Terms, (c) your violation of any law or third-party rights, or (d) your selection, installation, or use of products.

Privacy

Governing Law and Venue

These Terms are governed by the laws of the State of Nebraska, without regard to conflict of law principles. Any dispute must be brought in the state or federal courts located in Douglas County, Omaha, Nebraska, and you consent to personal jurisdiction and venue there.
